the control pad will only let you set the temp in the fridge to 34 but it is staying at 37 after being closed all night. could this be a damper issue or is this fridge different?

Check the freezer temperature, should be below zero.

Yes, if the freezer evaporator is free of ice, the freezer temperature should have no trouble getting below zero and the airflow into the fridg will improve, driving the temperature lower.
