The other night while trying to make a pork roast, the oven was set to 350. Well..the house started to fill with smoke and low and behold the baking element was no longer on, just the broil unit.

We shut the oven off but it didn't shut off until we unplugged it.
Plugged it back in today (for safety concerns wasn't about to plug it in over night) and the same thing happened. Turn it on, baking unit comes on then off and the broil unit comes on and even when we turn the dial to off, it still stays on.

Unplugged it again. Plugged it back in after several hours and it's heating up again. I can't afford a new stove right now.

Could it be the sensor within the oven itself? Or is it my worst thought..the control panel?

I would say it is the control panel/board.
The sensor should not cause the element to run unless you turn the stove on using the timer.

Unfortunately the board is not available.

There are companies out there that will repair boards, just Google "appliance timer repair"

Could be that the broil relay contacts are welded together.
You may be able to replace the broil relay, if it has manufacturer's numbers on it so that you can find a replacement.
Of coarse you will need a soldering gun and some soldering experience.

There is a possibility that the electronics that control the relay are shot and are holding the element always on.
