The first two temp switch settings do not work (water is hot) . Hot and warm settings work fine. Seems obvious the problem is the temp switch? Could it be a less obvious problem? I'd like to confirm that before ordering a $50 part. Any comments?

Since you are getting warm on that setting, the hot and cold valves are opening correctly, so it would seem that the water temp selection switch is bad.

If you order from this site (those of us who reply are volunteers and are not associated with the parts operations of APP) and it does not fix your problem you can return the part. See the returns policy before ordering.
