My Kenmore 500 toploader does not delay and drain the water after agitation cycle. It starts the spin cycle while full of water which makes it spill over. Already checked the lines and the pump. I thought it used to have a delay after agitating while the water was pumped/drained and started the spin cylce empty of water.

After agitation, the motor should stop for a few seconds, then start up in the opposite direction for drain only. This is called neutral drain. After drain, it should stop again for a few seconds and then start up again for drain and spin. The neutral drain mechanism gets set during the first few seconds of agitation. The latch that prevents spin during drain engages after the first few seconds of drain/spin mode.

Even though your washer doesn't appear to be operating in nuetral drain, it should still start draining when it starts spinning.

I checked again and it is not doing a neutral drain. It goes straight into the spin cycle with a full tub of water and water starts to spin out over the top of the tub. Is there a part that could be bad?

Sounds like the neutral drain mechanism is not working. You can replace the gearcase or open it up to inspect. A neutral drain kit is available.
