the tub leaks at the top of it when the water setting is on high water. Is the seal at the top supposed to be water tight. or could it be over filling?

Is the water level near the top of the tub when it fills up, like less than an inch from overflowing?

Rich the water level when filled is at least 2" below the top.

That's too high. Pull the plastic hose off the water level switch and blow in it, might be soap residue partially blocking the bottom of it.
If still a problem, replace the water level switch.
