the washer will fill, than it buzzes with a slight odor like a stuck solinoid, than after a while it will start and finish cycle

Three possibilities, the capacitor, the switch on the motor or the motor itself. The motor itself is more likely but try changing out the other two first.

I replaced the capacitor, and starter switch on the motor, I checked continuity on the motor windings, no open circuit. the unit still hums after fill up, then the thermal overload kicks in, at least now I can move the timer switch to spin and drain out the water, could it be the timer switch, or cycle switch? For being less than 4 years old, and the fact it cost $430.00 I am ready to chuck it

I think it is the motor, unusual, but it could happen.

It could also be a bad timer as it works in spin. Timer AP3721800 about $137
|

Richappy is right if it spins; I got the impression it it did not spin but only drained. Check the coupling if that is the case.
