fresh food temp always 41-42F whether set at 34, 40 or 46

I have read the threads about fresh area being too warm, but this is a strange problem because the fridge is cooling, but it isn't working quite right. It's under warranty, and a repair person came by. He didn't disassemble anything, just used an IR thermometer and said "it's fine, there's no problem".
This fridge has separate evaporators for fresh and frozen. I have placed in it one analog appliance thermometer, one digital thermometer intended for outdoor use, and one digital cooking thermometer whose sensor is sitting in a glass of water. All are showing the same thing, within 1F: the fresh food area is at 41-42F. The freezer temperature is fine (several degrees too cold but who cares).
Strangely, it does not matter whether I set the temperature to be 34 (the lowest allowed), 46 (highest allowed) or anything in between. I'm waiting 12 hours each time after changing the setting, Even if the setting is 46, the temperature reading is 41-42.
I can hear a slight hum of a fan, but I can't feel air from the vents. I forced a defrost and the temperature as displayed on the panel went up to 59, but the temperature in the fridge stayed about the same.
If the fridge were warm, I would get warranty service without a problem, but it is cooling. It's just not getting to the normal range of 35-38, and it's just at the edge of the FDA legal limit (41).
