Mystery . . can you solve food burns on bottom, mooshy on top

Hi, long story short . . . . bought this electric, double oven on 11-26-13 and it has been weird since the start. After 8, yes 8, service calls no technician can find an issue, not even when on the phone with Whirlpool factory service. They say nothing is wrong, I say look at my burnt muffins. I could go on about their lack of concern for us ... but not needed.
The bottom oven burns the bottom of the food and the top of the food is mooshy and uncooked. We are calibrated to -30, but it doesn't matter. To me it seems like the top element is not working right and the bottom element is picking up the slack. I know how these elements work, just a dead short and they are on or off, no dimmer switch (right?). When the tech puts his probe in it cycles from (if set to 350) 325 to 375. .. . they say this 25 degree swing is normal. Is it possible that the temp of the bottom element is way hotter than the top element, therefore burning? If you can help that would be great. Whirlpool will not pay for another service call unless they find something wrong.
