I replaced the thermal cut off and the thermostat didn't think to check element same problem looked at element and it was shorted to housing, will this cause my new thermal shutoff and thermostat to fail again?

Yes it will probably blow the thermal cut-off again.

It depends how the element shorted.
In some cases the element is controlled by the high limit thermostat instead of the operating thermostat. The high limit's contacts are not designed to open/close often so they will fail. Often they weld together and this then blows the thermal cut-off.
